Avoiding Labour and Employment Litigation
Many recent cases serve as a good reminder of some general principles that employers can follow to try and avoid litigation or at least have a good defence if litigation is unavoidable. Employers must always try to treat employees with respect and not to base decisions on assumptions. This is particuarly important in the human rights context. As well, employers should try to be seen to be reasonable in their demands and conduct.
