Caselaw Update
This paper examines 6 recent court decisions of particular interest to local governments: (i) a B.C. Supreme Court decision on in camera approval of a First Nations Servicing Agreement, (ii) a B.C. Supreme Court decision on a tree bylaw being inapplicable to allow an agricultural use permitted under a zoning bylaw; (iii) an Ontario Court of Appeal decision that qualified privilege extends beyond Council meetings; (iv) a B.C. Court of Appeal decision that a zoning bylaw can restrict occupancy of rental units to tenants; (v) a B.C. Supreme Court decision that navigated development permit guidelines and (vi) a B.C. Supreme Court decision that adjudicators have no discretion to cancel a bylaw notice where a bylaw contravention is found.
