Caselaw Update
This paper examines 4 recent court decisions of particular interest to local government: (i) a Supreme Court of Canada decision on snow clearing liability and “core policy decision” immunity, (ii) 2 B.C. Court of Appeal decisions on local government and approving officer liability for development approvals and the use of section 219 covenants to protect from such liability, and (iii) a B.C. Supreme Court decision applying the rarely used “community of interest” exception to council member conflict of interest restrictions.
