Virdis v. North Vancouver (City) 2009 BCSC 1118

This challenge to an OCP amending bylaw dealt with whether the rather distinctive legislative process of the City involved separate reconsideration and adoption motions for bylaws. A group of 6 owners applied for rezoning and amendment of the OCP. Following the public hearing and three readings, the OCP amending bylaw was before council on December 3, 2007. The motion was defeated on a vote of 4 to 3.
