North Cowichan Succeeds Before British Columbia Court of Appeal

On November 22, 2012 the District of North Cowichan was cleared by the British Columbia Court of Appeal to supply groundwater to the 6,000 residents of the Chemainus. The District had been prohibited earlier from using this new water supply by the BC Supreme Court as a result of findings that the Provincial Crown had failed to adequately consult and accommodate the Halalt First Nation. In unanimous reasons, the British Columbia Court of Appeal overturned this earlier ruling and allowed the District's appeal. This decision now clears the way for the District to provide this superior water supply to its residents.
